This Acceptable Use Policy (“AUP”) is a Policy under the Cato Service Terms and applies to your use of the Services. Capitalized terms not defined in this AUP have the meanings given in the Service Terms or Governing Agreement.
You will not, and will not permit or facilitate any End User or other person to, use the Services:
(a) for any illegal, fraudulent, deceptive, or abusive activity;
(b) to violate, infringe, or misappropriate the legal rights of another person or entity, including Intellectual Property Rights, privacy rights, or publicity rights;
(c) to threaten, promote, encourage, or facilitate terrorism, human trafficking, child sexual exploitation or abuse, or violence or other serious physical harm;
(d) to create, host, distribute, or facilitate phishing, scams, impersonation, or other fraudulent or deceptive activity;
(e) to distribute or facilitate malware, viruses, worms, Trojan horses, corrupted files, malicious code, or other material intended to damage, disrupt, intercept, or gain unauthorized access to systems, networks, software, or data;
(f) to access or attempt to access any system, network, account, device, software, or data without authorization, including by probing, scanning, testing, circumventing security measures, intercepting traffic, or obtaining credentials without permission;
(g) to interfere with or adversely affect the security, integrity, availability, or operation of any system, network, computer, communications system, software application, or computing device, including through denial-of-service attacks or similar activity;
(h) to distribute, publish, send, or facilitate unsolicited mass email, messages, promotions, advertising, or solicitations (“spam”);
(i) to disable, interfere with, circumvent, or attempt to circumvent any security, technical, usage, or access control of the Services or equipment used to provide the Services; or
(j) otherwise to use the Services to facilitate conduct that would violate this AUP if undertaken directly by you.
2.1. Monitoring. Cato may monitor activity associated with the Services for purposes of security, abuse prevention, operational integrity, and verification of compliance with this AUP, subject to the Governing Agreement and applicable Privacy and Security Terms.
2.2. Investigation. Cato may investigate any suspected violation of this AUP and may request information or cooperation reasonably necessary to investigate or remedy a violation. You will reasonably cooperate with such requests.
2.3. Enforcement. If Cato reasonably determines that use of the Services violates this AUP, Cato may take action permitted under the Governing Agreement and Service Terms, including requiring corrective action, removing or disabling access to affected content or resources where applicable, or restricting or Suspending affected Services.
2.4. Reporting to Authorities. Cato may report conduct that it reasonably believes violates applicable law to appropriate law enforcement, regulatory, or governmental authorities and may cooperate with lawful investigations or legal process in accordance with applicable law and Cato’s applicable Privacy and Security Terms.
When Cato identifies a suspected or confirmed violation, Cato may send an abuse notification (“Abuse Notification”) to the security contact associated with your Account or, if no security contact is configured, to another appropriate Account contact.
An Abuse Notification will identify the affected Service or resource, the nature of the violation, any required corrective action, the applicable response deadline, and one of the following response levels:
3.1. “Suspended.” Cato has already Suspended or restricted access to the affected Service or resource under the Governing Agreement or Service Terms. You must contact Cato and complete any required corrective action before restoration. Restoration may depend on the severity of the violation and the adequacy of the corrective measures taken.
3.2. “Cease Immediately.” You must stop or remedy the identified activity within the period stated in the Abuse Notification. If you do not do so, Cato may Suspend or restrict the affected Service or resource without further notice where permitted under the Service Terms.
3.3. “Warning.” You must remedy the identified activity within the period stated in the Abuse Notification. Failure to do so may result in escalation to “Cease Immediately,” “Suspended,” or other action permitted under the Governing Agreement and Service Terms.
3.4. Response Obligations. You must comply with the corrective actions and response deadlines stated in an Abuse Notification. Failure to comply, or repeated violations of this AUP, may result in further action permitted under the Governing Agreement and Service Terms.
Any person or entity may report suspected abuse or other violations of this AUP involving the Services through the Abuse Report form available on the Cato Support site (https://cato.digital/support/).
